This is exactly WHY debt settlement works so well, because it&#8217;s a better deal to the creditor or collector than any other option, such as a lawsuit, collections or bankruptcy.<br/><br/>With the economy getting worse and bad debt more than doubling in 2009, expect the value of bad debt to drop even further, which means better settlements and more savings for you!<br/><br/><strong>KEY # 2) Documentation BEATS Conversation, every time.</strong><br/><br/>DO NOT make any payments by phone.<br/><br/>Collectors will almost always ask for a check by phone. Say this:<br/><br/>&#8220;Unfortunately I&#8217;m unable to make a payment at this time; and am hoping to bring resolution to this matter as soon as possible. I understand you want me to make a payment right now, but that just isn&#8217;t possible. I will have $_________ (state an amount that&#8217;s roughly 35-50% of your balance, not a percentage but a round number) soon and want to settle at least one of my accounts with whoever will give me the best deal. Overdue accounts are often sold to collection agencies, its important to deal directly with the companies that you owe.<br/><br/>Make a list of phone numbers to call. This list should consist of the exact amount of debt that you owe as well as who you owe this money to. Also include account numbers and the date you went delinquent if you can find it. As soon as a payment is missed an account becomes delinquent. These accounts must be at least 90 days behind in order for creditors to consider settlement offers on them. Meaning for three months before the account can be negotiated on the account is accumulating late fees, penalties and increased interest rates. Some accounts are usually better negotiated on with the original creditor before they are sent to a collection agency and some are better off going to a collection agency for negotiation. This information is key when negotiating unsecured debt.<br/><br/>Who knows this information better than an unsecured debt negotiator? Not too many people do. That is why it is best to let a professional handle all negotiations on delinquent accounts. The experience and the know how a debt negotiator possesses is unique and invaluable.<br/><br/>If collection calls and letters, threats from collectors are too much too handle maybe it is time to seek help. Debt negotiation companies can help lessen that stress greatly. Debt negotiation companies will contact creditors and collectors and aim for all phone calls on a client&#8217;s behalf to go to them. Not all calls will be stopped but they will lessen. Negotiators will use a document called a Power of Attorney to try and give clients a chance to eat dinner in peace. What are you going to do now? Who do you call? You&#8217;re only human and probably too embarrassed to talk to anyone so you put the stack of papers on the dresser and forget about them. That is a big no-no. Why is this? When you finally read the stack of papers you need to take note of the very first sentences. Here the court is informing you and the person suing you there is a pre-trial conference scheduleded.<br/><br/>This simply means there is no trial date set yet. There is a way for the court to bring both parties together to try and negotiate a settlement. Now isn&#8217;t that strange? Here I am trying to teach you how to negotiate your debts and here&#8217;s the court system ORDERING both parties to try and negotiate the debt. My, isn&#8217;t this ironic in that you have waitied for the legal system to order you to do that which I am trying to teach you.<br/><br/>I will say this one time. It is very important to understand that you finally have an opportunity to talk to someone about your past debt, whether or not you owe the amount being sued for or not. Remember when the moron called you on the phone, berating you for not paying your debts? You were very honest and wanted to talk to someone about how much you owed and whether or not you could make a payment arrangement. But you got stuck with the village idiot who wasn&#8217;t in the least interested in your plight. This why I don&#8217;t want you to talk on the phone with, or heaven forbid, call a bill collector.<br/><br/>If you do not have any money to pay the bill, you can always negotiate a settlement. Be prepared. Bring a copy of your paycheck, car payment, rent payment, phone bill and all other bills. the meidator will figure out how much you can afford to pay on a bill and in most cases the suing party will accept the mediator&#8217;s award. If you are not prepared, how can anyone determine your ability to pay?<br/><br/>REMEMBER THIS! If you do not how up to mediation you will automatically lose. The judge will not have even seen the case. Just because you failed to show up the opposing party automatically gets awarded whatever they asked for. Whether or not you owed anything, they will get it. So is it worth it to show up and defend yourself? Absolutely. It is highly unlikely that a creditor to who you owe $15,000 is going want to lower your payments to such a point that it is going to take you years to pay back. 			<content:encoded><![CDATA[<p><br/><br/>In the past many people have hired lawyers or debt settlement companies to negotiate their credit card payoffs for them. This is still an option, but you need to be careful before you decide to use them. Many times when you use debt settlement companies to handle your negotiations, you will end up with marks on your credit report that are as bad as bankruptcy.<br/><br/>Another thing to keep in mind if you are thinking about hiring a professional to do this for you is the cost. Many will charge you an initial set up fee, then either several hundred dollars or a monthly fee. One thing to keep in mind is these companies are also paid a percentage of what they negotiate your payoff amount to. This percentage is paid by the credit card company. So it&#8217;s in their best interest to negotiate a higher payoff amount than you want.<br/><br/>But there is hope. Everything they do for you, you can do yourself for a fraction of the cost. The way these services work is they submit dispute letters on your behalf, and charge you hundreds of dollars to do it, with no guarantee of success. They send the same letters you can for the cost of a stamp and a little bit of time.<br/><br/>Sit down before you start calling them and determine how much you can afford to pay them. Write down whatever that amount is so you know that you can not go over that amount in your negotiations. Also figure out how long it will take you to pay off the amount you agree on. Use several different amounts to get a rough timeline so you know about how long it will take no matter where you end up in negotiations.<br/><br/>The easiest cards to settle are going to be those that you are behind in payments on already. If you are not behind, it will be harder to negotiate a payoff because there is no indication that you are having trouble paying the bill.<br/><br/>Now when you sit down to make the call, document everything. The name of the person you talk to, date and time of the conversation, what you agree to, and anything else that strikes you as important.<br/><br/>I recommend that you start out with an offer to pay off 25% of the total debt. Don&#8217;t worry that its too low, they are going to counter with something close to 100%. If you have several cards that are behind in payments, it will be easier to get them to settle lower. Be prepared to settle at around 50% or a little higher.<br/><br/>You need for them to believe that a settlement that high is going to be very difficult for you. Then you can make the stipulation that if you settle that high, they need to remove all late payment notations on the account, and show a notice that the account was &#8220;Paid as agreed.&#8221; If they don&#8217;t agree with those tell them you will not pay anything then and will stop paying them all together.<br/><br/>After that they will become much more likely to give you what you want in negotiation. Before you pay a penny toward the negotiated amount, tell them they need to send you a letter spelling out and agreeing to the terms negotiated on the phone. If they don&#8217;t include everything agreed to on the phone, call them back and tell them about the discrepancy. Let them know that if everything agreed to on the phone is not in the letter you will not pay anything.<br/><br/>Start this process with the card with the lowest balance. This will be the quickest to pay off, and then free up the money from that payment to put toward other cards. It is a way of reducing debts that does not involve completely destroying a credit score.<br/><br/>Debt settlement is a new way of dealing with debt and credit problems. It involves negotiating a debt settlement problem with a creditor. Typically, a debt counselor will help in the negotiation of the plan to remove debts. This whole concept is a legitimate solution for consumers whose credit card debt is overwhelming. The concept is equally useful for people who have fallen behind on payments as it is for people who are barely able to afford the minimum payment.<br/><br/>Unfortunately, no solution to debt is completely free from potential downsides. Debt settlement, like other options, will have a negative effect on a person&#8217;s credit rating. Fortunately, this will be less drastic than if an individual files for bankruptcy. There is also the possibility that the creditor will take legal action to collect the full amount owed to them. The final potential downside is that creditors will continue to call until the debt is settled.<br/><br/>The potential for negative consequences is diminished in Florida due to the state&#8217;s favorable debtor laws. Florida provides its citizens with numerous rights and protections concerning past due amounts on unsecured accounts such as medical bills, credit cards, repossessions, and personal loans.<br/><br/>All states have laws that require collection agencies to stop contacting a consumer if the consumer sends a Cease and Desist letter or a Power of Attorney letter which tells the collection agency that a third party is responsible for handling all communications with the creditor. Florida protects its citizens more by limiting the harassment from collection agencies as well as the original creditor (this is the bank or credit card company). The same laws which regulate and restrict what a collection agency can do also restrict the harassment abilities of original creditors.<br/><br/>In addition, Florida has set up laws that frequently completely protect a debtor&#8217;s wages and homes. Wages are protected by the state&#8217;s wage garnishment laws. This legal structure gives a creditor more of an incentive to settle.<br/><br/>Many cases, despite all of these protections, do end up in court. This is because creditors always have the right to sue a debtor as a means of collecting a past due amount.
